Abstract

In 2018, Nevada established the first standalone Gambling Treatment Diversion Court in the U.S. The success and challenges of Nevada's gambling court will be highlighted. There has been a trend and movement to establish gambling treatment courts throughout the U.S. as well as past diversion programs that previously existed. The first court diversion program dedicated to crimes involving a severe gambling disorder was established in Amherst, New York. There was a program in the State of Louisiana. Recently, the State of Ohio enacted through judicial creation a gambling diversion program in criminal cases. Currently, there is pending legislation before the New Jersey legislature to create gambling courts. Gambling courts save lives and taxpayer money. With the rapid expansion of gaming in the U.S., there is a need to increase awareness of responsible gambling, prevention, and measures to provide help to severe compulsive gamblers and reduce recidivism.

Author Bios

Honorable Cheryl Moss is the first Judge to create and preside over Nevada’s first Gambling Treatment Diversion Court. Judge Moss retired in 2021 after having served as a family court judge for twenty years and returned to the bench as a Senior Judge. Judge Moss continues to devote efforts to establishing gambling treatment courts in other states.

Honorable Scott Frederick retired from the Ohio Courts and earned an LLM in Gaming Law at UNLV Las Vegas. Judge Frederick is the co-author with Senior Judge Moss of "The Shuffled Deck: Nevada's Gambling Treatment Diversion Court and Future Expansion of Gambling Courts in the United States," UNLV Gaming Law Journal: Vol. 12: Iss. 2, Article 4.
