Abstract

There is a well-recognised close relationship between creative and juridical writings. At times, authors of creative texts adapt juridical elements in the form of minor details, or broad thematic bases, so as to create convincing fictional realities. Alternatively, they use the same aspects to comment on socio-juridical problems in an ambiguous or ironic fashion. This study focuses on the history of these processes and, specifically, on certain key examples in the works of Miguel de Cervantes, seen in relation to multiple legal documents, including a late sixteenth-century manuscript that details punishments for erotic crimes.
